They don't know yet whether or not it had Terrain Avoidance gear because they haven't found it yet.

They do know it did *not* have a TAWS system aboard... nor did it stupidly not have a cockpit voice recorder or data recorder. Even though NTSB had pleaded with the FAA to make that mandatory for that big a passenger craft (can hold up to 12), it was not made official until 2005 and that was a 1991 helicopter. Had that been installed on there, this probably never would have happened. The helicopter contractor was told it should have been retro-fitted as a safety precaution but they did not do it...so somebody is going to pay dearly for that lapse in judgement you'll see.

Any aircraft is subject to the discussion of the captain of that aircraft, he is to be the final decision maker on whether the aircraft should fly or not. Should he sub come to "pressure" to fly
when there is a valid reason not to fly he has made a bad choice. That day the local police choppers decided it was not safe to fly. To fly VFR the pilot was not required to have that talked about equipment updates. My best guess is that one or more people on board wanted very badly to be at the game and he may have felt a need to please them and all onboard paid with their lives. A very sad event.
